This Privacy Policy describes how SARL GLOBA collects, uses, and protects the personal data processed in connection with the use of the MarineSnap website and application (together, the “Service”).

By using the Service, you acknowledge that you have read and understood this Privacy Policy and agree to the processing of your personal data as described herein. This Privacy Policy should be read in conjunction with our General Terms of Use and Sale and Legal Notice, available on the Site.

In certain cases, SARL GLOBA may also act as a data processor where the Client (maritime surveyor, survey firm, etc.) determines the purposes of processing data collected through the Application. This relationship is governed by a Data Processing Agreement (DPA) available upon request or at [link].

2. Data Collected

MarineSnap collects only the data necessary to provide the Service:

 

Identification and contact data:

Name, surname, email address, telephone number, company name.

 

Account and authentication data:

User identifier, encrypted password. Authentication may be handled via third-party identity providers (Google/Firebase Authentication).

 

Professional data:

Information relating to survey assignments, vessels inspected, and professional qualifications.

 

Photographs and uploaded files:

Images or documents associated with survey reports.

 

Billing and payment data:

Billing address, payment history, and transaction information. Payment processing is handled by Stripe; SARL GLOBA does not store credit card details.

 

Technical data:

IP address, device type, operating system, browser type, and application usage logs.

3. Purposes and Legal Basis

Personal data is processed for the purposes and on the legal bases set out below (Article 6 of the GDPR):

4. Data Recipients

Personal data may be disclosed to the following categories of recipients:

  • SARL GLOBA and its authorised personnel
  • technical service providers (hosting, maintenance, support)
  • Stripe, for secure payment processing
  • administrative or judicial authorities, where required by law

 

Personal data is never sold or transferred to third parties for marketing purposes.

5. Hosting and International Transfers

Data is hosted on servers located within the European Union (OVH, France).

Where certain service providers (for example, Stripe, analytics tools, or messaging services) transfer data outside the European Economic Area, such transfers are carried out in compliance with applicable safeguards, including European Commission adequacy decisions or Standard Contractual Clauses (SCCs) pursuant to Article 46 of the GDPR.

6. Data Retention

Personal data is retained only for as long as necessary to fulfil the purpose for which it was collected:

7. Data Security

SARL GLOBA implements appropriate technical and organisational measures to protect personal data against loss, alteration, unauthorised access, or disclosure. These measures include:

  • encryption of communications (HTTPS/TLS)
  • encrypted data storage where appropriate
  • regular backups
  • access controls and authentication
  • connection logging and monitoring
  • secure hosting infrastructure

 

In the event of a data breach posing a risk to the rights and freedoms of individuals, SARL GLOBA will notify the CNIL and the affected data subjects in accordance with Articles 33 and 34 of the GDPR, within the applicable timeframes.

8. Client Responsibility (Processor Relationship)

Where the Client collects and uploads personal data into the Application (such as photographs or personal information of third parties included in survey reports), the Client remains the data controller within the meaning of the GDPR.

In this context, SARL GLOBA acts as a data processor and processes such data solely in accordance with the Client’s documented instructions and the terms of the Data Processing Agreement (DPA). A copy of the DPA is available upon request at contact@marinesnap.com or at [link].

The Client warrants that it has obtained all necessary consents and established an appropriate legal basis for any personal data it uploads to or processes through the Application.

9. Your Rights

In accordance with the GDPR and French Law No. 78-17 of 6 January 1978 (Loi Informatique et Libertés), you have the following rights with respect to your personal data:

  • Right of access: to obtain confirmation of whether your data is being processed, and a copy of it
  • Right of rectification: to correct inaccurate or incomplete data
  • Right to erasure: to request the deletion of your data (“right to be forgotten”), subject to applicable legal retention obligations
  • Right to object: to oppose the processing of your data on grounds relating to your particular situation
  • Right to restriction: to request limitation of processing in certain circumstances
  • Right to data portability: to receive your data in a structured, commonly used, and machine-readable format
  • Right to withdraw consent: at any time, without affecting the lawfulness of processing carried out prior to withdrawal
  • Right to define post-mortem instructions: under French law, to define instructions regarding the retention, erasure, and disclosure of your data after your death

SARL GLOBA will respond to your request within one (1) month of receipt. This period may be extended by a further two (2) months where necessary, taking into account the complexity of the request and the number of requests received. You will be informed of any such extension within the initial one-month period.

10. Automated Decision-Making and Profiling

SARL GLOBA does not carry out any profiling or automated decision-making that produces legal effects or similarly significant effects on users.

11. Changes to this Policy

SARL GLOBA reserves the right to update this Privacy Policy at any time to reflect changes in legislation, technology, or organisational practices.

Material changes will be communicated to users by email and/or by notice within the Application. The current version is the one published on the Site or within the Application at the time of your visit.

Continued use of the Service after notification of material changes constitutes acceptance of the updated Privacy Policy.
