4. Access to the Site and Application

The Site is publicly accessible and provides information about the MarineSnap service.

The Application is a subscription-based software-as-a-service (SaaS) platform intended for professional use. Access to the Application requires a valid user account and an active subscription (monthly or annual). Use of the Application is governed by the General Terms of Use and Sale, available at [link].

The Site and Application are accessible 24 hours a day, 7 days a week, except in cases of force majeure, scheduled maintenance, or technical issues. SARL GLOBA uses commercially reasonable efforts to ensure continuous availability but cannot guarantee uninterrupted access and shall not be held liable for temporary service interruptions.

5. Intellectual Property

All elements of the Site and Application — including but not limited to text, graphics, logos, icons, images, software, source code, databases, and underlying technologies — are the exclusive property of SARL GLOBA or its licensors, and are protected by applicable intellectual property laws.

Any reproduction, representation, modification, distribution, or exploitation of these elements, in whole or in part, without prior written authorization from SARL GLOBA, is strictly prohibited.

Content created by users within the Application (including photographs, notes, and generated reports) remains the intellectual property of the respective user. By using the Application, users grant SARL GLOBA a limited, non-exclusive licence to host, process, and technically transform such content solely for the purpose of providing the MarineSnap service. Further details are set out in the General Terms of Use and Sale.

6. Personal Data and Privacy

SARL GLOBA is committed to protecting the personal data of its users in compliance with Regulation (EU) 2016/679 (General Data Protection Regulation — GDPR) and French Law No. 78-17 of 6 January 1978 (Loi Informatique et Libertés).

Data collected and purposes:

Personal data collected through the Site and Application (such as name, email address, company details, and usage data) is processed for the following purposes:

providing and operating the MarineSnap service, including photo collection, data processing, and report generation (legal basis: performance of a contract)
managing user accounts and subscriptions (legal basis: performance of a contract)
improving the service and analysing usage patterns (legal basis: legitimate interest)
sending service-related communications (legal basis: legitimate interest); marketing communications, where applicable, are sent only with prior consent

Data hosting and transfers:

User data is hosted on servers located in France (OVH). If any data transfer outside the European Economic Area is required (for example through third-party sub-processors), appropriate safeguards will be implemented in accordance with the GDPR.

Data retention:

Personal data is retained for the duration of the contractual relationship and for any additional period required by applicable law. Account data is deleted or anonymised within twelve (12) months following account closure, unless a longer retention period is required by law.

Your rights:

8. Liability

The Site is provided for informational purposes. SARL GLOBA endeavours to ensure the accuracy of the information published on the Site but does not warrant that it is complete, accurate, or up to date. SARL GLOBA shall not be held liable for any errors or omissions in such informational content.

Regarding the Application: MarineSnap is a tool that assists professionals in collecting data and generating reports. Users are solely responsible for the accuracy, completeness, and appropriateness of the data they enter into the Application and for verifying the content of any reports generated. SARL GLOBA is responsible for the technical integrity of the report generation process but does not review, validate, or endorse the substance of user-generated reports.

To the fullest extent permitted by applicable law, SARL GLOBA’s total aggregate liability arising out of or in connection with the use of the Site or Application shall not exceed the total fees paid by the user to SARL GLOBA during the twelve (12) months preceding the event giving rise to the claim. This limitation does not apply where liability cannot be limited under mandatory applicable law.

9. Governing Law and Jurisdiction

This Legal Notice is governed by French law.

In the event of a dispute arising out of or in connection with the use of the Site or Application, and in the absence of any mandatory provision to the contrary, jurisdiction shall be granted exclusively to the competent courts within the jurisdiction of the Court of Appeal of Aix-en-Provence, France.

Nothing in this clause shall prevent the application of mandatory consumer protection or other mandatory legal provisions of the user’s country of residence, where applicable.

10. General Terms of Use and Sale

Use of the MarineSnap Application is subject to the General Terms of Use and Sale, available at [link]. In the event of any conflict between this Legal Notice and the General Terms of Use and Sale, the General Terms shall prevail with respect to subscription terms, service levels, and contractual obligations.
